These Terms are a legally binding agreement between you and us. The Privacy Policy, the POPIA Notice and the Data Deletion page at the links in section 15 explain how personal information is handled, and are to be read with these Terms.
The app helps you record movable business assets on your own device, and offers optional AI features (identification, invoice reading and market-value estimation) that use credits. It is intended for business use and is not designed for or directed at children. It is not for land, buildings, fixed installations or stock.
On first install you may save up to 5 assets free, and the app includes 10 free AI credits to try the AI features on them. No payment details and no account are needed. Once you have saved 5 assets, saving further assets requires an active plan. Nothing already saved is taken away: your register stays readable, exportable and available for encrypted backup and restore whether or not you ever subscribe.
When a plan is first bought on a device, the app adds a once-off grant of welcome AI credits, as stated in the app at the time.
The free allowance and welcome credits are a gift, not a purchase. Free credits expire 12 months after the app was first installed on the device, and welcome credits 12 months after they are added. We may change or withdraw the free allowance and welcome credits for new installs and new plans at any time.
Plans are sold as auto-renewing yearly subscriptions through Google Play: - Solo: one device. - Team: your device plus two team devices. - Extra seat add-ons: additional team devices. Add-ons only add seats to a Team plan and grant nothing on a Solo plan. Only one subscription per product may be held at a time.
Every plan includes direct sync to a supported accounting system (currently Xero). Direct sync is a paid feature. Exporting your register to a file is not: PDF, CSV and the accounting-import CSV are available on every plan, free included.
Prices are those shown in Google Play at the time of purchase. We may change prices; Google notifies you before a price change affects a renewal, and you may cancel before it does.
Plans have no free trial; the free allowance in 5.1 is how you evaluate the app. Your plan starts, and the first period is charged, as soon as Google Play confirms your purchase. Before the Google Play purchase sheet opens, the app states that the plan starts as soon as Google Play confirms the purchase and that continuing confirms your acceptance of these Terms. By accepting these Terms and proceeding with the purchase, you agree that the service commences immediately on confirmation of the purchase, and that the seven-day cooling-off right in section 44 of the Electronic Communications and Transactions Act, 2002 does not apply to it, the service having commenced with your consent before the expiry of that period (section 42(2)(d) of that Act). The same applies to credit packs, which are delivered to the device immediately.
This does not affect your ability to request a refund from Google Play within 48 hours of purchase under Google Play's refund policy, which Google applies on its own conditions. After 48 hours, refund requests are made to us and are considered as set out in 5.6.
If your plan lapses, expires or is cancelled: - Your register remains yours. You keep full access to view, search and export everything already saved, including PDF, CSV, the accounting-import CSV, and encrypted backup and restore. These are never withheld for non-payment. - Direct accounting sync pauses. It resumes when a plan is active again. Anything already sent stays in your accounting system. - Already-captured team work still delivers. Outstanding team captures can still reach the owner's device. - New captures stop beyond the free allowance in 5.1, and team devices stop capturing when the plan ends. - Unused paid credits remain spendable on assets already saved, within their three-year validity.
All billing, renewals and cancellations are handled by Google Play under Google's terms. Cancel or manage your plan in Google Play, under Subscriptions. Cancelling stops the next renewal; it does not refund the current period.
A refund may be requested from Google Play within 48 hours of purchase under Google Play's refund policy, on the conditions Google applies. Any request made after 48 hours is made to us at info@vitalpursuit.co.za and is considered at our discretion, acting reasonably and having regard to the extent to which the service or the credits have already been used. This clause does not affect any right you have under South African law that cannot be excluded.
If a subscription is refunded, charged back or otherwise voided, the plan ends immediately on every device it covered, and assets captured under it count towards the free allowance in 5.1.
Refunded credit packs are revoked in full. If a credit-pack purchase is refunded, charged back or voided, the number of credits that pack granted is deducted from your balance, including credits already spent. Your balance can therefore go negative, in which case AI actions are unavailable until a new pack brings it above zero; everything else in the app keeps working. The app tells you when such a deduction happens. An AI run costs us money the moment it runs; a refund returns your payment, so it must also return the credits it bought.
If you connect an accounting system, the app talks to that system directly from your device, using a login and authorisation you complete with that provider. We are not a party to that connection: its access tokens are stored on your device only, and none of your asset data passes through our servers on its way to your books. - It creates new assets as drafts in your accounting system. Your bookkeeper reviews and registers each draft there. The app never registers, disposes of or deletes an asset in your books. - For an asset your accounting system has already registered, that system's record is the master. The app shows it read-only and changes only the asset's name, serial number and description, and only when you explicitly confirm a "Correct in Xero" action. - It reads your fixed-asset list to match assets and reflect their status. - You can disconnect at any time from the Export screen; disconnecting revokes the app's access. Anything already sent remains in your accounting system under that provider's terms.
You remain solely responsible for the accuracy of your books. Your accounting provider's own terms and privacy policy govern what happens to data once it is there.
You agree not to misuse the app, including: reverse-engineering, interfering with or abusing the AI service; attempting to exceed or circumvent credit limits, the free allowance or plan checks; automated or bulk requests; sharing a seat with a person the organisation has not authorised; or using the app unlawfully or to infringe the rights of others.
The AI features are for photographing and documenting movable business assets only. You must not submit any image, document or text that: - is sexual or pornographic, depicts nudity, or sexualises any person; - depicts child sexual abuse material or the sexual exploitation of a minor in any form; - depicts graphic violence, gore or self-harm, or promotes harm; - is hateful, harassing or unlawful, or infringes another person's rights; or - contains personal information of other people that you have no right to submit.
The app is provided on a reasonable-endeavours basis. AI features need an internet connection and depend on third-party providers (currently Google Play, Google Cloud, OpenAI and, if connected, your accounting provider), whose availability, pricing and conduct we do not control. We do not promise that the app or any feature will be available, uninterrupted, error-free or fit for your particular purpose. Capturing and managing assets works offline.
To the maximum extent the law allows, the app and every feature of it are provided "as is" and "as available", without warranty of any kind, express or implied, including any warranty of accuracy, merchantability, fitness for a particular purpose or non-infringement. This section does not exclude a warranty that the Consumer Protection Act says cannot be excluded.
Please read this section carefully, because it limits what you can claim from us. - To the maximum extent the law allows, we are not liable for any indirect, incidental, special or consequential loss; loss of profit, business, revenue or goodwill; loss of or damage to data; or any loss arising from reliance on AI output, from an error in a file you exported or synced to your accounting system, from the unavailability of a third-party service, or from your loss of a device, backup or passphrase. - Our total liability to you for all claims arising out of or in connection with the app in any 12-month period is limited to the amount you paid us through Google Play in that period. If you paid nothing in that period, we have no liability to you beyond what the law does not allow us to exclude. - Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under South African law, or removes any right you have under the Consumer Protection Act.
You indemnify us against any claim, loss, fine or cost (including reasonable legal costs) arising from your breach of these Terms, from unlawful use of the app, from content you submit, from anything you send to or change in your accounting system, or from an organisation's treatment of its workers' information in team mode.
These Terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of the South African courts, without prejudice to any right to approach the National Consumer Commission, the Consumer Goods and Services Ombud or the Information Regulator where those apply. If any provision is unenforceable, the rest of the Terms remain in force.
